Suggestive list of conducts amounting to Sexual Harassment

(Under the POSH Law in India)

It may be difficult to categorize a particular conduct as an act of sexual harassment and the same may depend on the situation and vary from case to case basis. It is up to the complaints committee to decide whether or not certain conduct falls under the definition of sexual harassment as provided in the Act. Based on the definition of the term in the Vishaka guidelines, the POSH Act defines sexual harassment in section 2(n) as follows:

 “’sexual harassment” includes any one; one of  the following unwelcome acts Or -behaviour (Whether directly or by implication) namely:-

• Physical’ contact-and advances; or
•   A demand request for sexual favors; or making sexually colored remarks; or
• Showing pornography;” or
• Any other unwelcome physical, verbal or non-verbal conduct  of sexual nature;
